Legal Laser Episode Three: A Legal Insight into Article 21 of Indian Constitution

The third episode of Legal Laser, a live legal awareness and legal aid webinar series hosted by www.newsspace.in, was conducted on Sunday, 4 Pm, March 2024. The episode focused on the fundamental right to life and personal liberty enshrined in Article 21 of the Indian Constitution in the light of Niyati and Niti. The event was attended by legal professionals, law students, and enthusiasts from all over the world watching at youtube.

The panel of speakers for this episode included Advocate Sanandan Chopra and Advocate Anika Bajpai, who provided valuable insights into the various aspects of Article 21. They were joined by the Anchor Advocate Aayush Tiwari, who shed light on the concept of free will vs determinism and its impact on society. The pannel was comprised of the most respected law graduates from upes.ac. in.

Advocate Sanandan Chopra, a renowned spiritual legal expert, started the session explaining the difference between the two terms – Procedures established by law and Due process of law. He emphasized that while the former focuses on the legality of the procedure, the latter ensures that the procedure is just, fair and reasonable. He also highlighted the significance of the phrase ‘procedure established by law’ being replaced by ‘due process of law’ in the Indian Constitution after the landmark judgment in Maneka Gandhi v. Union of India.

Advocate Anika Bajpai, a practicing lawyer, added to the discussion by elaborating on the various interpretations of Article 21. She stated that while the literal interpretation of the article focuses solely on physical liberty, the judicial interpretation has expanded its scope to include various other rights such as the right to privacy, right to live with dignity, and right to a pollution-free environment. She also spoke about the need for a comparative analysis of the Indian Constitution with other constitutions around the world to understand the evolution of Article 21.

Advocate Aayush Tiwari, a young and dynamic lawyer, brought an interesting perspective to the discussion by delving into the philosophical concepts of free will and determinism. He explained how these two opposing views have influenced the understanding of personal liberty in different societies. He also highlighted the role of societal norms and customs in shaping an individual’s choices.

The panelists engaged in a thought-provoking discussion on the impact of Article 21 on various aspects of society, such as criminal justice, healthcare, and environmental protection. They also addressed questions from the audience, providing a deeper understanding of the topic.

The webinar concluded with a vote of thanks from the host, thanking the panelists for their valuable insights and the audience for their active participation. The episode received an overwhelming response with over 1000 viewers tuning in to the live session.
